End User License Agreement (EULA)

1. License Grant

DepositGenie, Inc. ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to use the DepositGenie mobile application (the "App") for personal, non-commercial use, subject to the terms of this EULA.

Permitted Uses

  • Install and use the App on your personal iOS or Android device
  • Create documentation for your rental properties
  • Generate letters and evidence packages for tenant rights purposes

2. Restrictions

You may NOT:

  • Copy, modify, or distribute the App or its code
  • Reverse-engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App for commercial purposes (e.g., selling evidence packages to other tenants)
  • Rent, lease, lend, or sublicense the App to third parties
  • Use the App to create competing products or services

3. Ownership

The App, including all intellectual property rights, is and shall remain the property of DepositGenie, Inc. This EULA does not grant you any ownership rights to the App.

Your Content: You retain ownership of all photos, videos, notes, and other content you create using the App. By using the App, you grant Licensor a limited license to store and process your content solely to provide our services.

4. Updates and Modifications

Licensor may provide updates, patches, or new versions of the App from time to time. These updates may:

  • Add new features or improve existing ones
  • Fix bugs or security vulnerabilities
  • Change the App's appearance or functionality

Some updates may be required to continue using the App. By installing updates, you agree to the updated version of this EULA.

5. Data Collection and Privacy

The App collects and processes data as described in our Privacy Policy. By using the App, you consent to such data collection and processing.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the App will be error-free or uninterrupted
  • Warranties regarding the accuracy of deadline calculations or legal information

The App is a documentation tool, not legal advice. Consult an attorney for case-specific guidance.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business opportunities
  • Damages arising from your use or inability to use the App

Licensor's total liability to you shall not exceed the amount you paid for the App in the past 12 months.

8. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms.

Licensor may terminate this EULA at any time if you violate its terms. Upon termination:

  • You must immediately stop using the App
  • Delete all copies of the App from your devices
  • Licensor may delete your account and all associated data

9. Export Compliance

You agree not to export or re-export the App in violation of U.S. export laws and regulations. You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country.

10. Governing Law

This EULA is governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.

11. Severability

If any provision of this EULA is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Licensor regarding the App.

13. Third-Party Services

The App may integrate with third-party services (e.g., Firebase, Gemini AI). Your use of these services is subject to their respective terms and privacy policies. Licensor is not responsible for third-party services.
