1. Acceptance of Terms

By accessing or using the DepositGenie mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

DepositGenie, Inc. ("we," "our," or "us") reserves the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.

2. Description of Service

DepositGenie is a mobile application that provides:

  • Documentation tools for rental property condition (photo/video capture, checklists)
  • Arizona-specific legal deadline tracking (ARS § 33-1321 compliance)
  • Letter generation templates (demand letters, dispute letters)
  • Evidence export packages (PDF reports, ZIP files)
  • AI-powered dispute analysis (Complete tier only)

The App is NOT a law firm and does not provide legal advice. It is a documentation and automation tool designed to help you organize evidence and track deadlines.

3. User Responsibilities

You agree to:

  • Provide accurate information when creating an account
  • Keep your login credentials secure and confidential
  • Use the App only for lawful purposes related to tenant rights
  • Not attempt to hack, reverse-engineer, or compromise the App's security
  • Not share your account with others
  • Not use the App to harass, threaten, or defraud landlords or third parties

4. Prohibited Uses

You may NOT use the App to:

  • Upload fraudulent or falsified photos/videos
  • Generate defamatory or threatening letters
  • Violate any local, state, or federal laws
  • Distribute malware, spam, or unauthorized commercial content
  • Impersonate another person or entity
  • Scrape or harvest data from other users

Violation of these prohibitions may result in immediate account termination.

5. Subscriptions and Payments

DepositGenie offers four tiers:

  • Free: Limited features, watermarked letters
  • Single-Phase ($12.99): One-time purchase per property
  • Full-Move ($19.99): One-time purchase per property
  • Complete ($29.99): One-time purchase per property

Payment Terms

  • Payments processed via Apple App Store or Google Play
  • Purchases are non-transferable between properties
  • Prices are in USD and subject to change with notice
  • You are responsible for applicable taxes

Refund Policy

  • 14-day money-back guarantee: Full refund if requested within 14 days of purchase
  • No refunds after you've exported a complete evidence package (service delivered)
  • Refunds processed through Apple/Google (may take 5-10 business days)

To request a refund, email support@depositgenie.com with your transaction ID.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do NOT warrant that:

  • The App will be error-free, secure, or uninterrupted
  • Your evidence will be admissible in court (this depends on your jurisdiction and case specifics)
  • Deadline calculations are 100% accurate (you should verify deadlines with an attorney)
  • AI analysis will detect all disputes or contradictions

Use the App at your own risk. Always consult an attorney for case-specific legal advice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPOSITGENIE, INC. SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the App
  • Court cases lost due to inadmissible evidence or missed deadlines

Our total liability to you for any claim shall not exceed the amount you paid for the App in the past 12 months (maximum $29.99).

8. Indemnification

You agree to indemnify and hold harmless DepositGenie, Inc., its officers, employees, and affiliates from any claims, damages, or expenses (including attorney's fees) arising from:

  • Your violation of these Terms
  • Your use of the App
  • Your violation of any third-party rights

9. Intellectual Property

The App, including all content, features, and functionality, is owned by DepositGenie, Inc. and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App's code or design
  • Use our trademarks or branding without written permission
  • Reverse-engineer or decompile the App

Your Content: You retain ownership of photos, videos, and notes you create. By using the App, you grant us a limited license to store and process your content to provide our services.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the App or other users

You may terminate your account at any time via Settings → Account → Delete Account. Upon termination, all your data will be permanently deleted within 30 days.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
